2. The entire website as well as the elements that compose it and/or are presented there (including but not limited to: site structures, software, databases, furniture, designs and models, patents, texts, photographs, illustrations, diagrams, graphic representations, trademarks, logos, domain names, etc.) are protected under the provisions of the Intellectual Property Code.

Fermob is the sole holder of intellectual property rights on these elements, either originally or through a license or express authorization.

The use of all or part of these elements, particularly by downloading, reproducing, representing, disseminating, etc., for purposes other than personal and private use in a non-commercial context by the user, is strictly prohibited. Any infringement on Fermob's rights exposes the perpetrator to penalties, particularly those provided under the Intellectual Property Code concerning copyright infringement (Article L. 335-1 and following), designs and models (Article L. 521-1 and following), patents (Article L. 615-1 and following), and trademarks (Article L. 716-1 and following), as well as under the Civil Code in terms of civil liability (Article 1382 and following).

 

3. As part of the use of the website, Fermob may collect personal data relating to users, which are necessary for subscribing to the newsletter, creating a customer account, or any communication with the user, such as: title, name, surname, email address, password, phone number, etc.

No personal data is collected without the user's consent. The mandatory or optional nature of information to be provided to Fermob will be indicated beforehand. The user is under no obligation to transmit personal data to Fermob.

However, if the user refuses, Fermob will not be able to send the newsletter and/or respond to their messages. In any event, if the user no longer wishes to receive Fermob's newsletter, they may unsubscribe, once logged into the website, via the "My Account > Newsletter Subscription" section. The user may also unsubscribe from the Fermob newsletter by clicking the hyperlink included in each issue of the newsletter sent to them.

The information provided by the user must be complete, accurate, and up-to-date. Otherwise, Fermob will not be able to fulfill the user's requests.

In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the collection and processing of personal data relating to the user has been declared to the CNIL (No. 1691075). Each user has the right to access, rectify, and delete personal data concerning them that is collected and processed by Fermob. The user may exercise this right at any time by sending an email to privacy@fermob.com.

Fermob may place a "cookie" (an alphanumeric identifier) in the user's computer hard drive solely to recognize them during their next visits to the site.

The retention period for browsing information provided by "cookies" on the website will not exceed one year. It is recalled that the user may oppose the storage of "cookies" on their hard drive by configuring their internet browser software (Internet Explorer, Mozilla Firefox, Opera, Safari, etc.) accordingly. To do this, they are advised to refer to the user manual ("Help" section of the browser toolbar) of their internet browser software or to seek any useful information from the publisher of said software.
